1. Acceptance: Any order placed with HYQY-CASTING is subject to the following conditions. Orders are open for acceptance for up to ninety days unless otherwise stated. Confirmation is required upon receipt of the order.
2. Amendments: Any changes or modifications to orders must be agreed upon in writing by both parties. This includes changes to design, specifications, quantities, and delivery schedules.
1. Quoted Prices: Prices quoted are for unmachined, self-colour castings unless otherwise stated. Prices are based on current costs and are subject to change if there are delays or modifications to the order.
2. Price Adjustments: Any changes in design, weight, quantities, or specifications may result in price adjustments. Delays caused by insufficient information may also lead to price amendments.
1. Prepayment: A proportional prepayment of [Specify Percentage]% of the total order value is required upon order confirmation.
2. Final Payment: The remaining balance must be paid in full before dispatch of the goods.
3. Net Prices: Prices are net and due for payment by the end of the month following the month of dispatch, unless otherwise stated.
4. Separate Invoicing: When deliveries are spread over a period, each consignment will be invoiced separately and treated as a distinct account.
5. Late Payments: Interest may be charged on overdue accounts at a rate of [Specify Rate] per month.
1. Buyer-Supplied Patterns: Patterns supplied by the buyer must be in good condition and suitable for our production methods. Any necessary repairs or alterations due to normal wear and tear are the buyer's responsibility.
2. New Patterns: When new patterns or equipment are required, the buyer should consult with us. Patterns made and charged for in full become the property of the buyer.
3. Pattern Care: We take reasonable care of buyer-supplied patterns but do not accept liability for loss or damage unless caused by our negligence.
1. Estimated Times: Delivery times are estimates and not guaranteed. Delays beyond our control may occur.
2. Commencement: The delivery period starts upon receipt of all necessary information, drawings, and written instructions.
3. Delivery Variations: We reserve the right to deliver up to ten percent more or less than the quantities ordered unless otherwise agreed.
1. Included Delivery: Prices quoted include delivery to destinations in Great Britain, either by rail or road transport, subject to the carrier's conditions.
2. Special Delivery: Extra costs for special delivery methods requested by the buyer will be charged accordingly.
1. Notification: We are not responsible for damage, shortage, or loss in transit unless notified in writing within three days of receipt.
2. Handling: Goods must be signed for as "not examined" and handled according to the carrier's conditions.
1. Payment for Samples: Samples submitted will be payable by the buyer unless returned carriage paid within one month from the date of dispatch.
2. Approval: Sample castings may be submitted for buyer approval before bulk production, particularly when new or altered patterns are used.
1. Testing Costs: The cost of supplying, machining, or testing all test pieces required by the buyer will be charged extra.
2. Property Indications: Physical or chemical property figures are for guidance only and are not guaranteed unless specified margins are agreed upon at the time of order.
1. Agreed Defect Rate: Our products will meet the defect rate agreed upon in the contract. We are not responsible for defects within the acceptable defect rate.
2. Exceeding Defect Rate: If the actual defect rate exceeds the agreed rate, please contact us immediately to provide an appropriate solution.
3. Notification and Inspection: The buyer must inspect castings upon delivery and notify us immediately of any defects that exceed the acceptable defect rate.
4. Liability Limits: No claims will be accepted for machining costs or other expenses on defective castings unless the defect rate exceeds the agreed threshold.
Title to any goods supplied does not pass to the buyer until the invoice price is paid in full and all payments are cleared.
Contracts for export are subject to separate conditions of sale, which will be provided upon request.
The buyer shall indemnify us against all damages, penalties, costs, and expenses arising from any infringement of patents, trademarks, or copyrights due to work carried out according to the buyer's specifications.
